Terms and Conditions

The website, novark.in (“Site”) is an electronic web-based platform for exploring opportunities and enhancing outreach using the online search and other tools available for the job seekers (employees/candidates, etc.) and Employers (recruiters/organizations, etc.). It is owned and managed by Novark Services Private Limited. (“Company”) with its registered office at Basistha Chariali, Guwahati (Assam)- 781029 (India).

PURPOSE-

novark.in is envisioned only to serve as a medium of contact and exchange of information for its users / members / visitors who have an authentic intention to contact and/or be contacted for the purposes related to genuine existing job vacancies and/ or other career enhancement services.

CLAUSES-

The following expressions shall have the following meanings as defined below-

MEMBER: is any person (may be candidates/employees, recruiters/employers/organizations, etc.) who accesses the site for whatever purpose, regardless of whether said Member has registered with novark.in or said member is a paying customer for a specific service provided by the site. A Member includes the person using this site to access any information/services on the site.

SERVICES: is defined as the services to be provided by the Company (Novark Services Pvt. Ltd.) to the member at novark.in including the provision of facilities for the following-

A Member who wishes to submit a resume(s) to seek employment.
A Member who wishes to secure recruitment through novark.in
A Member who wishes to advertise at novark.in
Member who wishes to receive advertisements, newsletters and promotional messages on novark.in and through emails, if any.
A member who wishes to buy/subscribe any services like Resume Access/CV Download, Job Post, Brand Promotions, etc.

COMPANY: means novark.in owned and managed by Novark Services Pvt. Ltd.

MEMBER’S OBLIGATIONS-

Member can request for delete of his/her account (temporary or permanently) through our contact form available on the site.
The Member agrees and expressly states that he/she is solely responsible for the accuracy and completeness of the Registration Data/Profile and other information given to the Company in the application/registration for membership in order to use the Service(s). The Member will ensure that the data shared with novark.in doesn’t contain any fraudulent, false, misleading or manipulated facts.
The Member is responsible for the set-up or configuration of all the necessary equipment required to access the Service(s).
The Member will comply with all notices or instructions given by the Company from time to time in respect of the use of the Service(s).
The Member shall be solely responsible for all information retrieved, stored and transmitted through the Service by him/her.
The Member is solely responsible for the maintenance of confidentiality of the login information & others. This would include the Member’s password and Username and all activities and transmission performed by the Member at novark.in
The Member will immediately notify the Company of any unauthorized use of the Member’s account or any other breach of security known to the Member through the contact form available on the site.
The Member will pay promptly the Subscription Fees as required by the Company from time to time.
The Member will take all such measures as may be necessary (including or without limitation changing password from time to time) to protect the secrecy.
In case a member chose to discontinue his/her association with us, he/she can unsubscribe / remove his/her account by completing the delisting procedure available in his/her account or can request to the company for the same through the contact form available on the site.
With completing the registration at novark.in, member/s is/are agreeing to accept communications (through Calls/Chat/ Mails/SMS/WhatsApp or other alerts) receiving from the site time to time. This can also be deactivated by ON/OFF process in his /her account (user dashboard)

PROHIBITED USE-

The Member will not be allowed to provide any access to any person other than the authorized person(s) named/enlisted on the site to use the Service on the site.
The Member shall use the Service(s) only for the purpose for which it is subscribed.
The Member will comply with all applicable laws and shall not contravene any applicable law of India relating to the Services, including any regulation made pursuant thereto.
The Member shall not to use the Service for any unlawful purpose including without limitation criminal purposes.
The Member shall not to use the Service to send or receive any message, which is offensive on moral, religious, racial or political grounds or of an offensive, vulgar, obscene, malicious or menacing nature.
The Member shall be prohibited in persistently sending messages or make postings on novark.in to any other Member or third party who access novark.in without reasonable cause or for causing any peril, harassment, annoyance, irritation, or anxiety to any person.
The Member is prohibited to introduce, upload, post, distribute, publish or transmit any information or software that: a) Contains a virus, worm or other harmful component into the Internet or novark.in network system, b) Breaches on any intellectual property rights of any person or retain information in any computer system or otherwise with such intention, c) Is unlawful, or which may potentially be perceived as being abusive, defamatory, libelous, harmful, threatening, harassing, vulgar, obscene, or racially, ethnically, or otherwise objectionable, d) Is meant to mislead or deceive the other Members, e) Infringes any trademark, patent or copyright rights, etc.

In the event of a violation of any of the above-mentioned covenants by the Member, and same comes to the Company’s knowledge, the Company shall have the right to delete any material relating to the violations without prior notice to the Member. The Company shall issue a warning to the Member to discontinue any activity, which leads to the said violations, and in the event the Member continues with such activity, the Company has the sole authority to terminate or suspend the membership at novark.in and/or any other related facility. In addition to the right to indemnity available to the Company, the Company shall have the right to any legal remedy, against the Member to recover the loss suffered by the Company and the harm caused to the goodwill of the Company, due to such violation by the Member.

COPYRIGHT POLICY-

Member or other users may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that any work has been copied and posted on the novark.in service in a way that constitutes copyright infringement, please provide information to our Novark’s Team with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you (member) claim has been infringed; a description of where the material that you(member) claim is infringing is located on the our Site; your (member’s) address, phone number, and email address; a written statement by you (member) that have a good faith belief that the disputed use is not authorized by the copyright owner, its agent/teams, or the law; a statement by you (member), made under penalty of perjury, that the above information in your (member’s) Notice is accurate and that you (member) are the copyright owner or authorized to act on the copyright owner’s behalf. novark.in Copyright Team/Agent for Notice of claims of copyright infringement can be reached by writing to the address located under the Contact Us/Enquire Us section on the site.

PAYMENT / SUBSCRIPTIONS POLICY-

All payments for services at novark.in have to be made in favour of ‘Novark Services Private Limited.” only. All payments need to be made on 100% advance basis to continue to use of uninterrupted Paid Services.
We have not authorized any individual or organization to collect payments in any other name (i.e. any other individual or organization name) or via any personal accounts for any services rendered by novark.in. You (users) are informed that under no circumstances will novark.in be liable for any damage caused due to your (users) transactions / payments made to / in favour of such fraudulent individuals or organizations. To protect your (user’s) interests, please contact us immediately if any such fraudulent individual or organization tries to mislead you (user).
The Member, who is liable to pay Subscription Fees, shall pay it on demand even if the Member disputes the same for any reason. In the event that the Company deciding the dispute to be in the Member’s favour, the Company shall refund to the Member any excess amount paid by the Member free of interest. In the event of late payment by the Member of any sums due under this Agreement, the Membership and the services would stand terminated.

REFUND / MONEY BACK POLICY-

Once subscribed, the payment made by the Member for Paid service is not refundable and no claim for refund would be entertained. novark.in neither offers any guarantees for the accuracy, timeliness, authenticity nor advocates any of the content posted by the other Members. All the services are on a best effort basis.

REFUND ON THE BASIS OF FRAUDULENT TRANSACTIONS-

The Member is solely responsible for maintaining confidentiality, as well as all the activities and transmission performed through his/her account. He/she shall be solely responsible for carrying out any online or off-line transaction involving credit cards / debit cards or such other forms of instruments or documents for making such transactions. novark.in assumes no responsibility or liability for their improper use of information relating to such usage of credit cards / debit cards used by the subscriber online / off-line.

REFUND ON THE BASIS OF CHANGE IN PREFERENCE / DELAY IN PROCESS

As we at novark.in keep up high interactions with our clients and carry out the entire process with their approval thus there is no provision for any kind of full or partial refund.
Once an order is placed it cannot be cancelled as it is sent for processing immediately. Your personal preferences changed in the course of time, cannot serve a reason for refund or charge back.

CONFIDENTIALITY-

As novark.in is an online platform, so it cannot guarantee confidentiality of information provided by Members who use the Site, so any breach in privacy due to technical fault or any other means is not the responsibility of novark.in
The agreement between novark.in and the Member can neither be deemed as “non-poach agreement” nor can the same be termed or used as an alternative to “non-poach agreement” as novark.in being a public site, all information posted by Member on the Site goes to the public domain except information / data which is specifically assigned as a non-public / private character.
The Member is entitled access to his/her own data and information stored in the database at novark.in (subject to prior confirmation of identity) and may edit or amend such data and information at any time.
The Members need to be aware that when they voluntarily reveal identification-oriented information (name, e-mail address, etc.) in chat and bulletin board areas, such information may be collected by a third party resulting in unsolicited messages from third parties. Such interaction is beyond the control and liability of novark.in

MAINTENANCE OF SERVICE-

The Company may at any time deactivate or suspend the Member’s access to novark.in and/or the Services (as the case may be) without any prior notice in order to carry out system maintenance, upgrading, testing, repairs and other related work. Without prejudice to the other provisions of this Agreement, the Company shall not be liable for any loss and damage, costs and expense that the Member may suffer or incur, and no fees or charges payable by the Member to the Company shall be deducted, refunded or rebated, as a result of such deactivation or suspension.

MODIFICATION TO SERVICE-

The Company reserves the right to modify or discontinue the Service with or without notice to the Member. The Company shall not be liable to the Member or any third party should the Company exercise its right to modify or discontinue the Service.

SUSPENSION OF SERVICE-

Without prejudice to any other rights or remedies of the Company, the Company may suspend the Service(s) provided by the Company. Upon suspension, the Service shall be deemed to be terminated from the date stipulated by the Company and the Member shall be liable for all charges and fees incurred until that date.

Novark.in reserves the right to block the membership, if member places –

Objectionable Contents, including: Offensive, abusive, threatening, obscene, defamatory or libelous materials
Multiple Profiles, including: Only a single profile is allowed for each job opening.
False Contact Information, including: Any email address, phone numbers, postal address and any other means of contact material.

TERMINATION OF SERVICE-

The Company may terminate this Agreement with immediate effect, without prior notice to the Member and without further prejudice to all other rights:

If in the opinion of the Company, the Member has breached any of the terms or conditions of this agreement.
If in the opinion of the Company or any regulatory authority, it is not in the public interest to continue providing the Service to the Member for any reason.

Also, the following could be deemed as the reason for the termination of the services:

Harasses or advocates harassment of another person;
Is deliberately offensive to the online community, any such content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
Involves unsolicited mass mailing or “spamming”, the transmission of “junk mail”, “chain letters”;
Promotes any information that is misleading, is false or that promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
Promotes unauthorized or an illegal copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices;
Contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
Displays pornographic or obscene or sexually explicit material of any kind;
Provides any kind of instructional information about illegal activities such as violating someone’s privacy, making or buying illegal weapons, or providing or creating computer viruses, or hacking;
Solicits passwords or personal identifying information for commercial or unlawful purposes from other users; novark.in also reserves all rights to suspend or terminate the services if found the services is not being used as per the mentioned instructions or the case may be.

DISCLAIMER-

The Company shall not be liable for any loss of information howsoever caused whether as a result of any interruption, suspension, or termination of the Service or due to acts of God, natural calamities, virus / system attacks, hacking or otherwise, or for the contents, accuracy or quality of information available, received or transmitted through the Service.
The Member shall be solely responsible, and the Company shall not be liable in any manner whatsoever, for ensuring that in using the Service(s), all applicable laws, rules and regulations for the use of systems, service or equipment shall be at all times complied with.
The Company makes no representations and warranties of any kind, whether expressed or implied, for the Services and in relation to the accuracy or quality of any information transmitted or obtained through the Services of novark.in
The Company shall not be liable for any loss or damages sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning the Member’s account and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed.
The Company neither guarantees nor offers any warranty about the credentials, status or authenticity of the prospective employer/organization contacting the Members post, download of the resume or by access to the information/data posted by the Members.
The Company does not warrant that novark.in or any of the web sites linked to novark.in be free of any operational errors or that it will be free of any virus, worm, or other harmful component.
The Member acknowledges that it is not the Company’s policy to exercise editorial control over and to edit or amend any data or contents of any emails or posting or any information that may be inserted or made available or transmitted to a third party in or through novark.in. The Company may refuse, suspend, terminate, delete or amend any artwork, materials, information or content of any data or information or posting so as, in the sole opinion of the Company, to comply with the legal or moral obligations as placed on the Company and to avoid infringing a third party’s rights or any other rules, standards or codes of practices that may be applicable to the posting or the internet.
The resume / data fed by the Member can be updated by the Member alone and is solely their liability.
Company offers neither any guarantee nor warranty that there would be a satisfactory response or any response at all once the resume / data is fed by the Member.
It is the sole prerogative and responsibility of the Member to check the authenticity of all or any response received or information displayed. novark.in is a public site with free access and assumes no liability for the quality and genuineness of responses.
Company neither guarantees nor offers any warranty about the credentials of the prospective employer / consultant / organization which downloads the information/resumes and uses it to contact the Members on the site including prospective employer / consultant / visitor / Member.
For opted paid services, the services will begin only commence on receipt of payment and post the display, forwarding, emailing of the jobs / resumes the service would be deemed as granted irrespective of the response received.
Company uses a tested and automated algorithm for forwarding / search however, makes no representations and warranties of any kind, whether expressed or implied, for the Services and in relation to the accuracy and suitability.
Company provides job-related information posted by Employers / Recruiters / Consultants registered with it. However, it also posts some additional jobs including government jobs by collecting relevant information from other websites which include the State & Central Government official websites. The Member shall find links to the original source that showcase these Job Details. These Job postings with links have been placed only for convenience of the Members and not for any commercial gain or profit. novark.in is not responsible for the contents and also for the actual availability of the said jobs so advertised. novark.in grants its Members direct linking to the portals/sites/resources from which this information is collected and no prior permission is required for the same. However, we, the company do not permit our pages to be loaded/displayed/copied by any Member/Visitor for commercial / personal purposes on their websites.
Company does not represent or guarantee the truthfulness, accuracy, or reliability of any such job postings, the ability of such Government/private employers to offer job opportunities to candidates or the ability of candidates to fill job openings or any Member Content and makes no representations about any such jobs or Member Content on the website and the Members are cautioned to use common sense and proper judgment in this regard. novark.in is not involved in the actual transaction between employers and candidates. Any reliance on the content posted on website in respect of vacancies shall be entirely at the risk of the Member.
Company also not liable for any kind of fake/incomplete/other mislead resumes/CVs registered/uploaded by candidate(s) which are downloadable for the registered/ paid employer, if any.

INDEMNITY-

You, the member/user agree to indemnify and hold novark.in, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your/users use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your/users representations and warranties set forth above.

VARIATION-

The Company reserves the right to amend the terms and conditions contained herein and in the Services Guide at any time upon notice (in such form as may be determined by the Company) to the Member.
The Terms and Conditions of this agreement will be updated from time to time and posted at novark.in. The Member should visit the site periodically to review the Terms and Conditions. For the avoidance of doubt, the Member’s continued use of the Service constitutes an affirmation and acknowledgement of the amended terms and conditions.

MEMBER DISPUTES

The Members are solely responsible for any interactions at novark.in and novark.in reserves the right, but has no obligation, to monitor disputes between Members.
Company will not be party to any legal proceedings between Member and any other registered or free Member for any transactions through the Site. novark.in will always abide by governing / legal authorities order and cooperate fully through the process, but the costs of the same shall be recovered from the party that has implicated novark.in in such case.

GOVERNING LAW AND JURISDICTION-

Any dispute or matter arising from incidental use of novark.in is governed by the laws of India and the Member and the Company hereby submit to the exclusive jurisdiction of the courts at Guwahati (Assam), India only.

ADDITIONAL T&C –

Regarding Resume Display-

In case necessary inputs required by us/company for commencing the services are not received by us within 30 days of the payment, the order shall stand cancelled and the any amounts paid shall be appropriated & not refunded.
The amount paid entitles the subscriber alone to the service by novark.in for a period of subscription opted from the date of up-linking of the resume on the website novark.in or such other mirror or parallel site(s) as novark.in may deem fit and proper but such web host shall be without any extra cost to the subscriber / user.
Notwithstanding anything contained herein, through Resume Display service members resume is made available from the page of novark.in and can be by freely accessed by anyone/recruiter/employer.
Additionally, through this service member resume is also made a part of novark.in proprietary database, accessed only by companies/recruiter registered with us.
Company offers neither guarantee nor warranties that there would be a satisfactory response or any response at all once the resume is put on display.
Company neither guarantees nor offers any warranty about the credentials of the prospective employer/organization which downloads the information and uses it to contact the prospective employee / visitor / user / subscriber.
Company would not be held liable for loss of any data technical or otherwise, and particulars supplied by subscribers due to reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond novark.in reasonable control including but not limited to strikes, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities.
It shall be the sole prerogative and responsibility of the individual to check the authenticity of all or any response received pursuant to the resume being displayed by novark.in for going out of station or in station for any job / interview and novark.in assumes no responsibility in respect thereof.
Company reserves its right to reject any insertion or information/data provided by the subscriber without assigning any reason either before uploading or after uploading the vacancy details, refund if any shall be on a pro-rata basis at the sole discretion of novark.in
Company will commence providing services only upon receipt of amount/charges upfront either from subscriber or from a third party on behalf of the subscriber.
This subscription is not transferable i.e. it is for the same person throughout the period of subscription.
Company has the right to make all such modifications/editing of resume in order to fit the resume in its database.
The subscriber shall be assigned password(s) by novark.in to enable the subscriber to access all the information received through its site novark.in, but the sole responsibility of the safe custody of the password shall be that of the subscriber and novark.in shall not be responsible for data loss/theft or data/corruption or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. We/novark.in undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber
The subscriber undertakes that the data/information provided by him is true and correct in all respects.
The User of these services does not claim any copyright or other Intellectual Property Right over the data uploaded by him/her on the website
Service will be deemed approved if a user fails to review the profile for 7 days. Users are advised to add or remove any information on profile which are not relevant to user.

Regarding Recruiter Connection –

The payment for service once subscribed to by the subscriber/candidate/recruiter/employer is not refundable and any amount paid shall stand appropriated.
Through Recruiter Connection, the subscriber/candidate/recruiter/employer can buy credits to send messages to the recruiter of his/her choice.
Using the service, the jobseeker would be able to send a message of maximum characters as mentioned along with a subject line of limited characters.
Company offers neither guarantee nor warranties that there would be a satisfactory response or any response at all once the message is sent to the recruiter.
Company neither guarantees nor offers any warranty about the credentials of the prospective recruiter/organization which sees the message and downloads the information and uses it to contact the prospective employee / visitor / user / subscriber.
It shall be the sole prerogative and responsibility of the individual to check the authenticity of all or any response received pursuant to the connect message for going out of station or in station for any job / interview and novark.in assumes no responsibility in respect thereof.
This subscription is not transferable i.e. it is for the same person throughout the period of subscription.
The subscriber undertakes that the data/information provided by him is true and correct in all respects.
This service shall not be utilized by the user for uploading/transmitting content which is illegal or objectionable in any manner.
The User of these services does not claim any copyright or other Intellectual Property Right over the data uploaded by him/her on the website.

Regarding applications by Non-Registered Users –

The user undertakes that the data/information being provided by him/her in the resume is true and correct in all respects.
Company does not share personally identifiable data of any individual with other companies/entities without obtaining permission. novark.in may share all such information that it has in its possession for its own purposes including sending promotional mailers etc. and in response to legal process, such as a court order or summons.
The user undertakes that he/she will not disseminate false/objectionable/offensive material using these services.
This interface shall be exclusively for the purposes of authentic job applications; usage of the interface in any other manner is strictly prohibited.
Company neither guarantees nor offers any warranty about the credential’s authenticity, status or otherwise of the prospective employer/organization which downloads the resume/ insertion or information/data and uses it to contact the user.
The user shall not infringe on any intellectual property rights of any person/entity or retain information/download any information from any computer system or otherwise with an intention to do so.
The User/subscriber/visitor to novark.in or affiliated site(s) is prohibited from introducing/posting or transmitting information or software, which contains a computer virus, or a contaminant, worm or other harmful components on the internet or on novark.in site or sub-domains or on any affiliate sites or any other network system
Company will not be party to any legal proceedings between a user (e.g. a subscriber) and a party contracted through the site. In case novark.in is implicated in any legal proceedings, costs will be recovered from the party that names novark.in. However, will abide with any court order served on it through due process.
When you/member indicate interest in a Job Listing on novark.in, you/member are sending your/member CV/resume and application information including relevant documents to novark.in, and you/members are requesting and authorizing novark.in to make available such application information to the applicable Employer(s) for such Job Listing(s).
In addition, by using novark.in, you agree that novark.in is not responsible for the content of the Employer’s application form, messages, screener questions, testing assessments; required documents, or their format or method of delivery.
You/user consent to application, documents and any responses sent by the Employer or vice versa through novark.in being processed and analysed by novark.in according to these terms of use and novark.in Policy. novark.in shall store and process such information regardless of whether a job vacancy has been filled. novark.in may use your/members application materials (including public CVs and responses to employer’s questions) to determine whether you may be interested in a Job Listing, and novark.in may reach out to you about such Job Listing.
Information you/member post in public areas of novark.in sites or applications or make visible in the resume and profile database may be accessed, used, and stored by others around the world, including those in countries that might not have legislation that guarantees adequate protection of personal information as defined by your/members country of residence. While novark.in takes measures to safeguard your information from unauthorized access or inappropriate use, novark.in does not control these third parties and we are not responsible for their use of information you (member) give to us. Accordingly, you/member should not post sensitive information or any other information you would not want made public, to any portion of novark.in or application or to a public website.

Regarding Job Search & Resume Services –

The subscriber availing this service shall be deemed to have consented to be bound by all the applicable terms and conditions of this service.
Decision of novark.in regarding all transactions under this service shall be final and binding and no correspondence shall be entertained in this regard.
Company reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this service or any part thereof including charges, at its sole discretion at any time as may be required in view of business exigencies and/or regulatory or statutory changes.
Your/member mobile phone number will be used during the transmission of text/WhatsApp messages through the mobile service provider’s server for SMS / WhatsApp Service.
The membership is for your personal use only. You cannot transfer, assign or authorize your membership to any other person.
The subscriber understands that he/she can avail SMS Services at his/her discretion and the said service shall be availed in such options as are made available by novark.in from time to time.
This service is subject to guidelines/directions issued by Telecom Regulatory Authority of India or any other statutory authority from time to time.
The SMS or its contents once sent for availing the SMS services shall be treated as final and the same cannot be withdrawn, changed or retrieved subsequently under any circumstances.
Subscription Services provide you with access to certain Content for a selected period of time, which will be as indicated and chosen by you prior to purchase. The frequency with which you will receive the relevant Content will be notified to you at the time you subscribe for the service.
You/member will not post or transmit any content that is abusive, obscene, sexually oriented or against national interest. novark.in reserves the right to suspend your profile if any prohibitive or objectionable content is found and may further initiate appropriate legal proceedings against you.
The functions of the Service are dependent on the Operator owning the network to facilitate this service (Operator), for which novark.in does not undertake any responsibility for failure of this network transmission or failure of message transmission for any reasons whatsoever. From time to time, novark.in may include additional features and services.
Company reserves the right to modify/delete the profile contents at its own discretion without prior notice if the contents of profile are deemed unfit for broadcast.
Company is not responsible for authenticity of the content arising thereto.
The subscriber must maintain such minimum balance in his/her prepaid account as is specified by novark.in for availing the particular option offered under these services. All incidental costs/taxes/levies, if any, related to the VAS shall be entirely borne by the customer.

Subscribing or using various paid/free services of novark.in on SMS/Voice/WAP either directly or indirectly doesn’t in any manner guarantee the user a job.
Company and/or its respective suppliers make no representations about the suitability, reliability, availability, timeliness, lack of viruses or other harmful components and accuracy of the information, software, products, services and related graphics contained within the, novark.in sites/services for any purpose. All such information, software, products, services and related graphics are provided “as is” without warranty of any kind. novark.in and/or its respective suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services and related graphics, including all implied warranties and conditions of merchantability, fitness for a particular purpose, workmanlike effort, title and non-infringement. novark.in shall not be responsible or liable for any consequential damages arising thereto.
By agreeing to register at novark.in, a user allows novark.in to get in touch with him/her from time to time on events or offers regarding jobs and ancillary services on mobile. This can include exciting offers, information, as well as promotions.
The subscriber shall comply with all directions/instructions etc. issued by the Company relating to the network, the services and any/all matters connected therewith and provide the Company all other and further information and co-operation as the Company may require from time to time.
Registration presumes that the users have read, understood and accepted the terms and conditions.

Regarding Recruiters –

You will comply with all applicable data protection laws in relation to the processing of personal data; and not process personal data in an unlawful manner and excessive with regard to agreed purposes as defined in the privacy policy and this terms and conditions
You shall implement adequate technical and organizational controls to protect the shared personal data obtained from the Company against unauthorized or unlawful processing and against accidental loss, destruction, damage, alteration or disclosure
You agree to provide reasonable assistance as is necessary to facilitate the handling of any Data Security Breach (as relevant under privacy laws applicable) in an expeditious and compliant manner
You agree that the responsibility for complying with a data subject /data principal request lies with the Party which holds/processes the Personal Data collected/shared
You warrant and represent that the institution shall not disclose or transfer Personal Data obtained from the Company to any sub-processors without ensuring that adequate and equivalent safeguards to the Personal Data.
You shall retain or process shared Personal Data for no longer than is necessary to carry out the agreed purposes.
You shall act as an independent Data Controller in respect of shared personal data obtained from the Company once the data is collected by You and You shall be responsible for its secure use at all times.
To help maintain control over the account and to prevent any unauthorized users from accessing the account, you should maintain control over the devices that are used to access novark.in and not reveal the password or other confidential details associated with the account to anyone.

com may place restrictions on your account which may extend to disabling access in order case any suspicious activity is noted in your account.

Regarding Classified Job listing/job post –

Company shall place the information relating to vacancies in the Hot Vacancies & such other Classified sections on the website or such other mirror or parallel site(s) or in allied publications as novark.in may deem fit and proper but such additional web hosting shall be without any extra cost to the subscriber / user.
The insertion so displayed in the classified section of novark.in shall be for a fixed period/s, which period is subject to change without notice. Every instance of refreshing and existing listing entitles you to and additional fixed period starting from the date on which the listing is refreshed and shall be counted as fresh posting.
Company reserves its right to reject any insertion or information/data provided by the subscriber without assigning any reason either before uploading or after uploading the vacancy details, but in such an eventuality, any amount so paid for, may be refunded to the subscriber on a pro-rata basis at the sole discretion of novark.in
By posting/uploading a job posting on the website you confirm that you have obtained all licenses/permits as are necessary for recruitment and to indemnify novark.in against all claims, damages arising out of actions/claims that may be made in relation to the same.
com has the right to make all such modifications/editing of the vacancy details in order to fit its database.
The Subscriber/Recruiter will provide email id/other details for vacancies posted on novark.in in the Classified section to receive email notifications of applications, if any. The contact information given by the subscriber for all listing should be the same and the subscriber cannot give multiple contact information/data for the purpose of listing.
All information intimated by the subscriber / recruiter and displayed by novark.in becomes public knowledge and novark.in may at its sole discretion include the vacancy intimated by a subscriber for display on novark.in in any other media including the print media at no extra costs to the subscriber and novark.in shall not be held liable for usage/publicity of such information.
Company offers no guarantee nor warranties that there would be a satisfactory response or any at all response once the job is put on display.
Company shall in no way be held liable for any information received by the subscriber and it shall be the sole responsibility of the subscriber to check, authenticate and verify the information/response received at its own cost and expense.
Company would not be held liable for any loss of data, technical or otherwise, information, particulars supplied by the subscriber, due the reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond Novark.in ‘s reasonable control including but not limited to strike, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities.
Company will commence providing services only upon receipt of amount/charges upfront either from the subscriber or from a third party on behalf of the subscriber.
The subscriber/Recruiter shall be deemed to give an undertaking to novark.in that the jobs sought to be advertised on the classified section of novark.in are in existence, are genuine and that the subscriber / recruiter has the authority to advertise for such jobs.
The subscriber/Recruiter must give an undertaking to novark.in that there will be no fee charged from any person who responds to jobs advertised on the classified section of novark.in for processing of applications / responses from such person.
Company reserves its right to change the look, feel, design, prominence, depiction, classification of the classified section of Novark.in at any time without assigning any reason and without giving any notice.
The subscription is neither re-saleable nor transferable by the subscriber to any other person, corporate body, firm or individual. Usage from third party premises/networks without prior written permission of novark.in is not permitted.
The subscriber shall be assigned password (s) by novark.in to enable the subscriber to post vacancies on the site in agreed upon section(s), but the sole responsibility of the safe custody of the password shall be that of the subscriber and novark.in shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. novark.in undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber.
The User of these services does not claim any copyright or other Intellectual Property Right over the data uploaded by him/her on the website
